Terms and conditions

General delivery terms

All of our deliveries relate to the following terms and conditions. By ordering, the buyer agrees to these terms and conditions. VodaMed reserves the right to change prices listed in the pricelist as well as on our website without prior notice. P&P (Postage & Packing) are for the account of the buyer. P&P charge will be notified upfront.

1. Definitions In the following terms and conditions are defined: VodaMed: the user of the Terms and Conditions Purchaser: everyone that contacts VodaMed to place an order Order: every instruction towards VodaMed Force majeure: all circumstance beyond reasonable control of VodaMed

2. Special offers, description of goods An offer or (price) quotation does not oblige VodaMed and is meant as an invitation to place an order. An order only exists if it is accepted in writing by VodaMed. Placing an order The purchaser sends an order to VodaMed per email, web shop or otherwise. VodaMed confirms the order per email or as agreed with the buyer. The purchaser will be notified of possible differences in stated prices and prices on the invoice. VodaMed reserves the right to refuse an order without reason or to accept one under specific terms.

3. Delivery terms The delivery term is set within a maximum of 30 days. If the term is exceeded, the purchaser has the right the cancel the order. Unless a different delivery term has been agreed between the purchaser and VodaMed.

4. Delivery and risk Unless agreed in writing, VodaMed decides about the way of delivery. Products will be delivered to VodaMed on the risk of the purchaser. The purchaser is obliged to take receipt of the products at delivery. If the purchaser rejects the delivery, costs for returning the products will be charged to the purchaser.

5. Returning products The purchaser has the right to return the products to VodaMed within 7 days after receipt. VodaMed will then pay back the already received amount of money for the order within 30 days, minus costs for returning the products. This under the condition that products are received by VodaMed in the same condition as sent.

6. Disbandment If the purchaser does not fulfil its obligations, VodaMed is justified to disband the execution of the pending order(s) or any future orders.

7. Guarantees The guarantee that the purchaser receives on all products of VodaMed is equal to the guarantee that VodaMed receives from its suppliers.

8. Ownership reservation VodaMed will stay owner of all products, until all outstanding amounts for the products are completely paid for by the purchaser.

9. Prices Unless explicitly agreed otherwise, all prices of VodaMed are in EURO and inclusive VAT. Unless explicitly agreed otherwise, costs for packaging, shipment and all taxes and levying on behalf of the products and shipment will be charged to the purchaser. All these costs will be presented to the purchaser by VodaMed on the trial invoice.

10. Payment Payment of the orders will be settled cash on delivery (only in The Netherlands), by credit card, Paypal or by transferring the money directly to our bank account.

11. Reliability VodaMed can not be held responsible for product damage, other than with due observance of the given guarantees.

12. Force majeure In case of force majeure VodaMed can suspend its obligations towards the purchaser for the period of time of force majeure. If the period of time exceeds 1 month both parties have the right to disband the agreement or part of it in writing, if the situation justifies it. In case of force majeure the purchaser has no right for compensation of any loss or damage arising from circumstances beyond the control of VodaMed. VodaMed will contact the supplier as soon as possible in case of a (possible) force majeure.

13. Applicable law The Dutch law is applicable on these terms and conditions as well as to any agreement with the purchaser.

14. Other These terms and conditions are deposited at the Chamber of Commerce at Maastricht, the Netherlands. VodaMed can rewrite these terms and conditions at all times if desired.
